There may be
some legal difference between Canada and the US but I have included these
clauses in my contract, you may want to consider adding them to yours as well,
if they are appropriate. Some of them I pulled from other contacts I found
online or are currently used in the Ontario Real Estate Associations standard
listing agreement.
INDEMNIFICATION:
The Seller will
not hold the Auctioneer responsible for any loss or damage to the Property or
contents occurring during the term of this Agreement caused by the Auctioneer or
anyone else by any means, including theft, fire or vandalism, other than by the
Auctioneers gross negligence or willful act. The Seller agrees to indemnify and
save harmless the Auctioneer and any co-operating party from any liability,
claim, loss, cost, damage or injury caused or contributed to by the breach of
any warranty or representation made by the Seller in this Agreement or the
accompanying data form.
Bids
on Behalf of Seller:
Seller authorizes
the Auctioneer to bid up to the Reserve Price on behalf of Seller in order to
maintain the flow and integrity of the Auction. The Auctioneer is not obligated
to purchase the Property under any circumstances. The auctioneer may open
bidding on the Property by placing a bid on behalf of the Seller and may further
bid on behalf of the Seller, up to the amount of the Reserve Price, by placing
successive or consecutive bids for a Property, or by placing bids in response to
other bidders. However, the auctioneer will not make a bid greater than or equal
to the Reserve Price. The Auctioneer is not obligated to purchase the Property
under any circumstances.
This one I came
up with after listening to an episode of the Auctioneertech podcast. I
personally prefer to use absentee bidding over online bidding.

ABSENTEE
BIDS:
Seller acknowledges and authorizes the Auctioneer to accept at the auctioneer’s
discretion absentee bids. Seller acknowledges that absentee bids
will be entered on behalf of the bidder on a competitive basis.
Winning
Bidder as Intended Third-Party Beneficiary: Seller agrees
that the Winning Bidder is an intended third-party beneficiary of this Agreement
and to the extent that the Winning Bidder is harmed by Seller’s breach of this
agreement, the Winning Bidder shall have the rights of a third-party beneficiary
to this Agreement.
Legal,
Accounting or Environmental Advice: The Parties to
this Agreement acknowledge that the Auctioneer has recommended that the Parties
obtain independent professional advice prior to signing this document. The
Parties further acknowledge that no information provided by such the auctioneer
is to be construed as legal, tax or environmental advice.

There are some questions I have that are not quite clear yet but I will continue reading before I ask! But Real estate Auctions Are For Me!

for "Success in Real estate Auction Sales!". I was able to find a Coldwell
Banker Auctioneer in up-state NY. He sent me forms and auction agreements made
for NY. So I'm almost ready to start! But Billy, I'm stuck on a (10%) Buyer
Premium. If the bidder bids $500.k, does he have to come up with another $50.k
to win the bid? Also is this explained to bidders up-front and do they have a
problem with it?

Bonnie and I had a wonderful time in Ocean City meeting all of you and attending your seminar.
Bonnie and I thought your seminar was one of the best we had attended in a long long time.
All of you did a wonderful job and the material presented was first rate! Your material in the course was well done, well organized and presented in a logical and systematic manner and worth far more then what we paid.
The breakfast , lunch and all the goodies at the break were a special treat and very much appreciated and very thoughtful and refreshing.
The seminar presentation was excellent and Billie and Stephanie and Raleigh did an excellent job and were truly very willing and excited to share their knowledge and help and assist the attendees fully.
Bonnie and I felt the course was well worth the time, long drive and cost and we would recommend the course to real estate agents and those new and aspiring auctioneers that need to put it all together, as well as a great refresher for experienced realtors and auctioneers.
The CD was a bonus and a surprise and I was very happy that there were forms and contracts to help guide me in my own auction business.

Well I just returned from Billy Burke's class "Secrets of an AARE Auctioneer", wow what a class.
If you have ever thought about taking a class like this, this is the one!! Just to be able to have the contracts that he uses are worth alot more than the cost of the course. He outlines step by step how to deal with sellers and buyers, it is truly amazing.
We have been selling some Real Estate at auction, but now I realize that we have been approaching it all wrong.
